Welcome to The Fullest Project ("we," "us," or "our"). By accessing or using our website at thefullestproject.org (the "Site"), including the Caregiver Gig Board, you agree to be bound by these Terms of Use. If you do not agree, please do not use the Site.
1. About the Site
The Fullest Project is a nonprofit resource hub for caregivers of individuals with disabilities. We provide informational resources, community content, and a Caregiver Gig Board that allows users to post and respond to task-based opportunities. The Site is provided for informational and community connection purposes only.
2. The Caregiver Gig Board
The Caregiver Gig Board (the "Gig Board") is a community bulletin board that allows caregivers to post tasks they need help with or skills they wish to offer. By using the Gig Board, you understand and agree that:
- We are a platform, not a party. The Fullest Project acts solely as a venue for users to post and discover gig listings. We are not a party to any agreement, transaction, or arrangement between users. We do not employ, endorse, recommend, or guarantee any user, and we are not an employment agency, staffing firm, or contractor.
- No vetting or background checks. We do not verify the identity, qualifications, credentials, background, or suitability of any user who posts or responds to a gig. You are solely responsible for evaluating and verifying any person you choose to interact with.
- No guarantee of quality or safety. We make no representations or warranties regarding the quality, safety, legality, or fitness of any gig, task, service, or work performed as a result of connections made through the Gig Board.
- Transactions are between users. Any compensation, payment, trade, or exchange arranged through the Gig Board is solely between the users involved. We do not process, facilitate, hold, or guarantee any payments.
- Exercise caution. You should exercise your own judgment and take appropriate safety precautions when meeting or transacting with any person contacted through the Gig Board, including meeting in public places and informing others of your plans.
3. User Responsibilities
By using the Site and Gig Board, you agree to:
- Provide accurate and truthful information in all submissions
- Not post content that is false, misleading, fraudulent, defamatory, harassing, discriminatory, or illegal
- Not use the Gig Board for any unlawful purpose or to solicit illegal activity
- Not misrepresent your identity, qualifications, or intentions
- Comply with all applicable local, state, and federal laws, including tax and employment laws
- Respect the privacy and personal information of other users
- Not scrape, harvest, or collect user information from the Site
4. Content and Moderation
We reserve the right, but have no obligation, to:
- Review, edit, or remove any gig listing or user content at our sole discretion
- Refuse to publish any submission for any reason
- Suspend or terminate access for users who violate these Terms
- Set expiration dates on gig listings and remove expired or inactive posts
You retain ownership of the content you submit but grant us a non-exclusive, royalty-free license to display, distribute, and reproduce your submissions on the Site for the purpose of operating the Gig Board.
5. Disclaimer of Warranties
THE SITE AND ALL CONTENT, SERVICES, AND FEATURES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
6. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE FULLEST PROJECT, ITS FOUNDERS, OFFICERS, VOLUNTEERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR GIG BOARD, INCLUDING BUT NOT LIMITED TO: DAMAGES ARISING FROM INTERACTIONS WITH OTHER USERS; DISPUTES, FRAUD, THEFT, OR MISCONDUCT BY ANY USER; THE QUALITY, SAFETY, OR LEGALITY OF ANY GIG, TASK, OR SERVICE; ANY PERSONAL INJURY OR PROPERTY DAMAGE; LOSS OF DATA, REVENUE, OR PROFITS; OR ANY OTHER DAMAGES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED ONE HUNDRED DOLLARS ($100).
7. Indemnification
You agree to indemnify, defend, and hold harmless The Fullest Project and its founders, officers, volunteers, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: your use of the Site or Gig Board; your violation of these Terms; your interactions or transactions with other users; any content you submit; or your violation of any law or the rights of any third party.
8. Dispute Resolution
Any disputes between users arising from the Gig Board are solely between those users. We are not responsible for mediating, arbitrating, or resolving any dispute between users.
For disputes between you and The Fullest Project, you agree to first attempt to resolve the dispute informally by contacting us at hello@thefullestproject.org. If the dispute cannot be resolved within thirty (30) days, either party may pursue resolution through the courts of the Commonwealth of Virginia.
9. Third-Party Services
The Site uses third-party services including Formspree (form processing), Cloudflare (hosting and security), and Every.org (donations). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.
10. Resource Directory Disclaimer
Resources listed in our directory are provided for informational purposes only. Inclusion of a resource does not constitute an endorsement, recommendation, or guarantee of quality. We do not verify the accuracy, completeness, or current status of all listed resources. Always conduct your own research and due diligence before engaging with any resource, provider, or organization.
11. Not Professional Advice
Nothing on this Site constitutes medical, legal, financial, therapeutic, or other professional advice. Content is provided for general informational purposes only. Always consult qualified professionals for advice specific to your situation.
12. Changes to These Terms
We may update these Terms at any time. Changes take effect when posted on this page. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
13. Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of laws provisions.
